Oral Order:

On respondents 5 and 6 making an application to the Special Deputy Collector, Social Welfare—3rd respondent for eviction of the petitioners from the lands and restoration of the land an ejectment order was passed. Against which petitioners carried the matter in appeal to the 2nd respondent, which was also dismissed. Questioning the correctness of the same, revision was filed before the Government—1st respondent and pending revision interim suspension of the ejectment order was sought. As no orders were passed by the revisional authority—1st respondent, petitioners filed W.P.No.2826 of 1982, which was disposed of staying eviction until Government disposed of stay petition. In spite of the same, when proceedings are initiated for dispossession of the petitioners they filed the present writ petition seeking to stay the eviction and suspend the ejectment order till the disposal of revision and obtained stay of eviction.

In view of vacate petition filed by the Government and for the reasons mentioned in the counter affidavit this Court by order dated 27-03-1997 vacated the interim order granted earlier.

Learned Government Pleader for Social Welfare though took time to produce the copy of the order passed by the Government while disposing of the revision and make available the same to the petitioner’s counsel but failed to produce the same, whereas the learned Counsel for the petitioners submits that still revision is pending undisposed of.

In view of the same, the 1st respondent is hereby directed to dispose of the revision pending on its file, if not already disposed of, and communicate the said order to the counsel who filed the revision on behalf of the petitioners.

The writ petition is accordingly disposed of. No costs.
