Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a writ of mandamus or any other appropriate writ or order or direction declaring the inaction on the part of the respondents in not furnishing the records and enjoyment survey and other details with regard to Busarajupalle, Jainvarigudem, East Ragulakunta and Kangalavarigudem and Buttaigudem of Buttaigudem Mandal, West Godavari District and going ahead with the issuance of pattadar pass books to non-tribals landlords as illegal and unconstitutional and consequently direct the respondents to receive objections from the petitioners and other tribals while initiating action as per law to implement the land transfer regulations after making available final conclusions of the survey of four villages in Buttaigudem Mandal, W.G.District to the petitioners.

The Court made the following :

 ORAL ORDER: (per the Hon’ble the Chief Justice)

On 15th October, 2001, the writ petition was filed by the villagers falling within the Buttayagudem mandal, West Godavari District, which is a scheduled area as defined in the V Schedule to the Constitution of India questioning the inaction on the part of the respondents in furnishing copies from the records and enjoyment survey and other details with respect to a number of villages in their mandal and going ahead with issuance of pattedar pass books to non tribals. Affidavit was required to be filed by the respondents.

P.Wilson Babu, Mandal Revenue Officer, Buttayagudem Mandal, filed an affidavit stating that copies of the records which were asked for by the petitioners were supplied to the tribal leaders and also stating that it is open for the tribals to have copies of whatever record is available with the Mandal Revenue Officer, Buttayagudem for furtherance of their interest and pave the way for implementation of the Land Transfer Regulations. We take this assurance on record that as and when the tribals would like to have copies of the available records from the Mandal Revenue Officer, Buttayagudem, the same will be supplied, and close this petition.
