Relief Sought : to issue an appropriate writ or order or direction;(1) declaring the action of the respondents in not allotting the raw matedrial(sundra trees) to the petitioner as violative of Article 14, 19(I) (g) and 300-A of the constitution of India;(ii) declaring the action of the respondents in not issuing the orders on the decision taken at the meeting held on 27-11-1990 chaired by the Hon'ble Minister for Forests as arbitrary, illegal and direct the respondents to issue orders according to the decision taken at the meeting held on 27-11-1990 by the Hon'ble Minister for Forests; ( iii) a direction may be given to the respondents to renew the lease to the petitioner by allotting sundra trees; (iv) costs be awarded to the petitioner.
Relief Granted: "We find that no real exception can be taken to the direction of the learned single Judge by which Respondents 1 and 2 are directed to consider grant of lease Sundra Trees to the original writ petitioner from Khammam and Karimnagar in accordance with G.O. Ms.25, dt 12-2-92,entitles the original writ petitioner to such grant then only such grant of lease has to be given. In short, all these aspects are left for consideration to the appropriate authority in the light of the G.O concerned". |
