Relief Granted: "The appellate court found that there is no marriage between v.gagamma and R.Satyanarayana and disallowed her claim.so far as the paternity of the child is concerned, the lower appellate court ought to have remanded the matter to the original court to give an opportunity to both the parties. As illegitimate son nageswara(p2) is entitled for maintenance. In the case of illicit intimacy, certain oral evidence has to be required,particular,as this incident is said to have taken place in a tribal area where we can not expect documentary evidence. Therefore the lower appellate court's finding with regard to Nageswara Rao (p2) is concerned has been set aside and the matter is remanded to the original court for disposing of the claim of Nageswara rao (p2) after considering the evidence already on record and the evidence that is being produced by both the parties. So far as Gangamma(p2) is concerned no case is made out for interference" |

Rajahmundry and quash the same and grant maintenance to the petitioners 1&2@ Rs.300/- and Rs.200/- per month respectively with effect from the date of application and costs and pending disposal of the above petition, direct the 1 st respondent to submit himself before the authorities in Centre for Cellular and Molecular Biology, Hyderabad for DNA test to determine the parentage of the 2 nd petitioner .
Relief granted:" CCMB declined to take up DNA test. The case was dismissed". |
